question on early releasing helper

Hi!

I found out that I can release my helper 42 days prior to her visa expire date. I haven't given her annual leaves 14 days.( I think 16 days if I include Sundays)


My question is I want to release her about 1 month earlier than 58 days counted above. I want to give her 1 month paid leave so that it does not look like she is terminated.

Is this possible? I should report the day she leaves for her paid leave as her last day of work?

Or I need to terminate her?

I want to know if what I'm trying to do is not breaking any law.

Hello Shrek!

We hired a helper who left her employer 5 weeks before her contract ended. When we started processing the paperwork, immigration said that anything above 1 month is considered a termination. She needed to exit HK before we could submit the documents to immigration.
