Confused about process for hiring helper

I'm confused!

I need to find a helper to start at the end of February 2009. If I find somebody who is already in HK and is about to or has just finished a contract, do they then have to leave the country before the contract would start with me because of visa regulations or can they apply to stay?

Thanks for any advice anybody can give me.
 
If they are not renewing their contract with their existing employer at the end of their 2 years they do not need to leave immediately, but must take leave within the first 12 months. If they have had their contract terminated because of certain reasons - family leaving HK, mitigating financial circumstances the rules are the same. If however they have been terminated or have resigned then they will have to leave and it will take approx 6 weeks for the paperwork to be processed.
