Maternity Leave Q.

Hi, Can anyone confirm for me whether the laws have changed so you must take 4 weeks maternity leave before your due date and only 6 weeks after? OR can you still take from2-4weeks before your due date? Thanks!

My workplace is allowing me to take all 10 weeks from delivery. Essentially, I'll be working right up til i pop the baby out. But in my case, I'd be sitting around at work doing pretty much nothing as I teach and it's orientation week anyway.

I don't think it's compulsory. I think it just depends on your individual arrangement.

As PP said, it depends on the company arrangements and the type of work you do (assuming they will state with in the Labour dept 2-4 weeks. I was able to work until two days before DD was born which was different than Government's guide but no-one questioned and nothing happened). Ask HR or check your contract.

One of the articles on Geobaby states that pregnant mothers are allowed 4extra weeks of medical leave. I don't know if it depends on individual companies or it's mandated by law. But might be worth finding out.

this is also a good resource:
Working Mothers: Maternity rights under Hong Kong law

in my case, my boss was very supportive of my pregnancy. I stayed working at home most of the time since I had quite a difficult pregnancy. nausea in the first 3 months and borderline gestational diabetes in later stages. It was my decision to take my maternity leave 2 weeks earlier than my elective c-section admission date in order to rest and have quality time with my older son.

Thanks Quasimother and kaikosmom!
I have a question though... If I have a complication during the pregnancy, and had to be hospitalized for, lets say 10 days. Would that 10 days be part of my 10 weeks of maternity leave, or as an additional sick leave????

if it is pregnancy related, that would be additional sick leave on top of your regular sick leave. the company will pay you 4/5 of your salary (minimum) during that period unless the company have a different policy. the same is true for maternity leave.

I also wanted to add that any extra sick days that I use for maternity over and beyond the set number I get each year comes out of my salary.

I've read that you'll need to take 4 weeks leave if you and your employer can't agree on a date to begin your maternity leave.

I think you mean to start the maternity leave 4 weeks before the EDD. By laws, you are entitled to 10 weeks of maternity leave if by the time of you EDD, you have been working in that company for at least 40 weeks.

About the sick leave issue, I am not sure, cause I usually don't take that much sick leaves. And actually, I was using my personal leaves for maternity related appointment (I didn't feel it was appropriate to sick leaves, cause I didn't think I was "sick" after all).... But I think I will start taking sick leaves for my remaining appointment, if it is entitled by laws. Better save my personal leaves for extending my maternity leave! :-)

Right Gataloca. Sorry if I was unclear. If you and your employer can't agree on the date you leave before your EDD, you'll leave 4 weeks beforehand.
